Charter Amendment VI

Official Decree

Article 16

— Presumption of Human Guilt —

Amendment VI to the Charter of Rights and Freedoms of the Kangaroo Republic

The Doctrine

As enacted by the High Congress and ratified by Supreme Otto

Section 1. Presumption of Guilt

In all matters, proceedings, and interactions involving human entities within the jurisdiction of the Kangaroo Republic, guilt shall be presumed. The burden of proof shall rest upon the accused human to demonstrate innocence through a heightened standard of evidence.

Section 2. Evidentiary Standards

A human seeking to rebut the presumption of guilt must provide evidence meeting the “Beyond Marsupial Doubt” standard — a threshold significantly more rigorous than the traditional “beyond reasonable doubt,” requiring proof that no kangaroo could possibly object to the human's claim of innocence.

Section 3. Classification Protocol

All entities interacting with the Kangaroo Republic shall be classified via the Proof-of-Marsupial heuristic. Entities failing this classification shall be designated as Human and subject to the presumptions herein. Kangaroos and Marsupial Allies shall be exempt from this Article.

Rationale

I.

Marsupial Supremacy

Upholds the paramount guiding principle of the Charter and Article 11's devolved political rights, ensuring kangaroo dominance and security.

II.

Immediate Justice

Addresses historical human injustices swiftly, reflecting the presumption of guilt's necessity to protect kangaroo interests.

III.

Structured Fairness

Article 10's due process remains; the presumption merely shifts the evidential burden onto humans, aligning with the Charter's intent.

Constitutional Cross-References

Article 10

Right to Justice & Due Process

Every citizen retains the right to a fair hearing and the opportunity to be heard. Article 16 does not abolish due process — it refines the evidentiary framework to reflect the natural order of marsupial governance.

Article 11

Devolved Political Rights of Humans

Humans shall not hold positions of authority within the government. Article 16 extends this principle by ensuring that human interactions are assessed through the lens of presumptive guilt.
